Terms of Use

1. Acceptance of Terms

By accessing or using the Forensic Media Analyzer software ("Software") and the cyberforensicsexpert.com website ("Site"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Software or Site.

These Terms constitute a legally binding agreement between you ("User", "you") and CyberForensicsExpert ("Company", "we", "us").

2. License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Software for lawful forensic analysis purposes. This license does not include the right to:

• Modify, reverse-engineer, decompile, or disassemble the Software
• Redistribute, sublicense, or resell the Software
• Use the Software for any unlawful purpose
• Remove or alter any proprietary notices, labels, or marks
• Use the Software to fabricate, falsify, or misrepresent forensic evidence

3. Registration and Account

To download the Software, you must complete a registration form with accurate and current information. You are responsible for maintaining the confidentiality of any credentials associated with your account. You agree to notify us immediately of any unauthorized use.

We reserve the right to refuse registration, suspend, or terminate access at our sole discretion if we believe information provided is inaccurate or the Software is being misused.

4. Intended Use

The Software is designed as a forensic analysis tool to assist qualified professionals in examining digital media. The Software:

• Does not produce automated verdicts. All findings are presented to the analyst for professional interpretation and judgment.
• Is intended to support, not replace, professional forensic examination practices.
• Should be used in accordance with applicable laws, rules of evidence, and professional standards.
• Must not be used to fabricate, alter, or misrepresent forensic findings.

5. Intellectual Property

The Software, Site, and all associated content (including but not limited to code, documentation, AI models, detection algorithms, and design) are the intellectual property of CyberForensicsExpert and are protected by copyright, trade secret, and other intellectual property laws.

Nothing in these Terms transfers any intellectual property rights to you beyond the limited license granted in Section 2.

6. AI Models and Cloud Services

The Software may utilize local AI models (ONNX) and optional cloud-based AI services from third-party providers. When you choose to use cloud AI features:

• Media data may be transmitted to third-party AI providers for analysis
• Third-party provider terms and privacy policies apply to data processed by their services
• You are responsible for ensuring such use complies with your organization's data handling policies
• Local ONNX models process data entirely on your machine with no external transmission

7. Reports and Output

Reports generated by the Software (including MAT reports) are tools to support professional forensic analysis. The accuracy and admissibility of reports in any legal proceeding is the responsibility of the analyst. We make no warranties regarding the admissibility of reports in any jurisdiction.

8. Disclaimer of Warranties

THE SOFTWARE AND SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Software will be error-free, uninterrupted, or that detection results will be accurate in all cases. Forensic analysis inherently involves professional judgment, and the Software is a tool to assist — not replace — that judgment.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CYBERFORENSICSEXPERT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR DAMAGES ARISING FROM THE USE OR INABILITY TO USE THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability for any claim arising from these Terms or your use of the Software shall not exceed the amount paid by you for the Software in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless CyberForensicsExpert, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Software, violation of these Terms, or violation of any applicable law.

11. Updates and Modifications

We may update the Software and these Terms from time to time. Continued use of the Software after changes to these Terms constitutes acceptance of the modified Terms. We will make reasonable efforts to notify registered users of material changes.

12. Termination

We may terminate or suspend your license and access at any time, with or without cause, with or without notice. Upon termination, you must cease all use of the Software and destroy any copies in your possession.

13. Export Compliance

You agree to comply with all applicable export control laws and regulations. You may not export, re-export, or transfer the Software to any country, entity, or person prohibited by applicable law.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in the State of [Your State], United States.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CyberForensicsExpert regarding the Software and Site, superseding any prior agreements.
